This Privacy Policy explains how Overhead Innovations, a Virginia LLC (“Come Out and Play,” “we,” “us,” or “our”), collects, uses, shares, retains, and protects information when you use the Come Out and Play mobile application, website, support services, and related features (collectively, the “Service”).
By using the Service, you acknowledge the practices described in this Privacy Policy.
1. Scope
This Privacy Policy applies to information processed through the Service.
It does not apply to communications or activity that occurs entirely through third-party services, such as your device’s native text messaging application, except where we expressly state otherwise.
2. Information We Collect
2.1 Account Information
We may collect:
- email address;
- display name;
- internal user ID;
- age or confirmation that you are at least 18;
- authentication records;
- magic-link request and confirmation data;
- account status; and
- account creation and deletion timestamps.
2.2 User-Selected Location Information
We may collect:
- a ZIP code;
- a user-selected base area;
- an approximate geographic center derived from a ZIP code; and
- a broad search radius or activity-distance preference.
We do not collect or store continuous or precise device location unless we clearly introduce and disclose a feature requiring it and obtain any permission required by law or platform rules.
A ZIP code or base area may still be considered approximate location information.
2.3 Connections
We may collect:
- connection relationships;
- pending connection requests;
- QR-code or connection-code records;
- connection-code reset information;
- user-assigned nicknames, if stored on our servers;
- blocked-user relationships;
- activity-specific exclusions; and
- related timestamps.
If nicknames or contact associations are stored only on your device, they are not transmitted to or collected by our servers.
2.4 Activity Information
We may collect information related to activities, including:
- activity title;
- description;
- category;
- date and time;
- creator;
- invitees;
- attendance status;
- guest permission and guest count;
- participant count;
- broad activity area;
- exact meeting location;
- activity changes;
- cancellations;
- withdrawals; and
- related notifications.
Exact meeting details may be visible only to users who have accepted or joined the activity.
2.5 Reports, Blocks, and Safety Information
We may collect:
- reports submitted about users or activities;
- the reason for a report;
- supporting information;
- blocking and exclusion actions;
- moderation decisions;
- account restrictions;
- suspension or termination records; and
- communications with support related to safety, abuse, fraud, or policy enforcement.
2.6 Support Information
When you contact support, we may collect:
- your name;
- email address;
- account identifier;
- message;
- attachments;
- screenshots;
- technical details; and
- information needed to investigate or resolve the request.
2.7 Technical and Usage Information
We and our service providers may collect:
- device type;
- operating system;
- app version;
- language;
- IP address;
- server logs;
- timestamps;
- crash logs;
- diagnostics;
- performance information;
- push-notification token;
- security events;
- app interactions; and
- information about how the Service is used.
2.8 TestFlight and Beta Information
If you use an Apple TestFlight beta version, Apple and Come Out and Play may automatically receive crash logs, usage information, diagnostics, and feedback submitted through TestFlight.
Feedback may include comments and screenshots.
Beta versions may be incomplete and should not be used for important or irreplaceable information.
2.9 Information We Do Not Intend to Collect
Under the current design, we do not intend to collect:
- continuous GPS location;
- precise device location;
- your device contact list;
- text message content;
- phone numbers selected from your device contacts;
- message history;
- financial payment information;
- health information; or
- information for personalized advertising or cross-app tracking.
If our practices change, we will update this Privacy Policy and request consent where required.
3. How We Use Information
We may use information to:
- create and manage accounts;
- authenticate users;
- send magic links;
- establish and manage connections;
- generate and validate connection codes;
- display activities to authorized users;
- deliver invitations;
- manage attendance and guest counts;
- provide exact meeting details to accepted participants;
- send service and activity notifications;
- provide support;
- investigate reports;
- enforce blocks, exclusions, and account restrictions;
- prevent fraud, abuse, and unauthorized access;
- moderate content;
- improve reliability and performance;
- understand how the Service is used;
- comply with law;
- protect users, the public, and our legal rights; and
- operate, maintain, and improve the Service.
We do not use personal information for personalized advertising or cross-app tracking.
4. Legal Bases for Processing
Where applicable law requires a legal basis, we process information based on one or more of the following:
- performance of our contract with you;
- your consent;
- our legitimate interests in operating, securing, improving, and enforcing the Service;
- compliance with legal obligations; and
- protection of vital interests or safety where appropriate.
5. How Information Is Shared
We do not sell personal information.
We may share information as described below.
5.1 With Other Users
Depending on your connections and activity participation, other authorized users may see:
- your display name;
- a nickname they assigned to you;
- activities you create;
- invitations;
- attendance status;
- limited participant information;
- guest counts; and
- exact meeting details after acceptance or participation.
Users who are not connected to you may appear only as limited aggregate information, such as “+4 others,” rather than by name.
5.2 With Service Providers
We may share information with providers that help us operate the Service, such as providers of:
- cloud hosting;
- databases;
- authentication;
- email delivery;
- push notifications;
- crash reporting;
- diagnostics;
- analytics;
- maps or ZIP-code geocoding;
- security;
- support forms; and
- content moderation.
These providers may process information only for the services they provide to us, subject to contractual and legal restrictions.
5.3 For Legal and Safety Reasons
We may disclose information if we reasonably believe disclosure is necessary to:
- comply with law, regulation, legal process, or governmental request;
- protect a person from credible harm;
- investigate fraud, abuse, or security incidents;
- enforce our Terms;
- protect our rights, users, or the public; or
- respond to an emergency.
5.4 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to applicable law.
6. Device Contacts and External Messaging
Come Out and Play does not upload your device contact list.
The Service lets you optionally associate a Come Out and Play connection with a contact stored on your device, and open your device’s native text messaging application to reach that person.
When you use this feature:
- contact selection occurs on your device;
- the selected phone number and contact association stay on your device and are not uploaded to our servers;
- the message is composed and sent through your device’s messaging application;
- we do not receive the message content;
- we do not read message history; and
- we do not determine whether a message was delivered.
Your use of the messaging application is governed by your carrier and the provider of that application.
7. Advertising
We do not currently use personal information for personalized advertising.
If we display advertising in the future, we may use contextual information such as:
- the activity category being viewed;
- general region;
- season; or
- content of the current screen.
If we later introduce personalized advertising, cross-app tracking, or a materially different use of personal information, we will update this Privacy Policy and request consent where required.
8. Data Retention
We retain information only as long as reasonably necessary for the purposes described in this Privacy Policy.
Retention periods may depend on:
- whether your account remains active;
- whether information is needed to provide the Service;
- safety and fraud-prevention needs;
- dispute resolution;
- legal requirements;
- tax or accounting obligations;
- enforcement of our Terms; and
- protection of users or our legal rights.
We may retain limited records after account deletion when reasonably necessary for:
- safety;
- abuse prevention;
- fraud prevention;
- legal compliance;
- dispute resolution;
- enforcement of permanent administrative blocks; or
- protection against account recreation used to evade enforcement.
Where practical, retained information will be limited, restricted, or de-identified.
9. Account and Data Deletion
You may request deletion through:
- the in-app account-deletion feature; or
- our public account-deletion page.

Deletion may require confirmation through a magic link or similar security measure.
When deletion is confirmed, we may:
- cancel activities you created;
- withdraw you from activities;
- notify affected participants;
- remove connections;
- invalidate unused connection codes;
- delete or anonymize account information;
- delete or anonymize activity information; and
- retain limited records as described in the Data Retention section.
Deleting the app from your device does not by itself delete your account.
10. Your Privacy Choices
Depending on your location, you may have rights to:
- access personal information;
- correct inaccurate information;
- delete information;
- obtain a copy of information;
- object to or restrict certain processing;
- withdraw consent; and
- appeal certain privacy decisions.
You may also:
- update account information in the app;
- reset connection codes;
- remove connections;
- block users;
- change notification settings;
- leave activities;
- cancel activities you created; and
- delete your account.

We may need to verify your identity before completing a request.
11. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information.
These may include:
- encrypted network transmission;
- access controls;
- authentication controls;
- limited administrative access;
- logging;
- monitoring;
- secure hosting;
- security updates; and
- incident-response procedures.
No system is completely secure, and we cannot guarantee that unauthorized access, loss, misuse, or disclosure will never occur.
12. Children’s Privacy
The Service is intended only for adults age 18 and older.
We do not knowingly permit children under 18 to create accounts.
If we learn that a person under 18 has created an account, we may suspend or delete the account and associated information.
To report a suspected underage account, contact us through the support form.
13. International Processing
Information may be processed in the United States and other countries where we or our service providers operate.
Those countries may have privacy laws different from the laws where you live.
Where required, we use legally recognized safeguards for international transfers.
14. State Privacy Disclosures
Residents of certain U.S. states may have additional privacy rights.
We do not sell personal information and do not share personal information for cross-context behavioral advertising as those terms are defined under applicable state privacy laws.
We will not discriminate against you for exercising a privacy right.
15. Third-Party Links and Services
The Service may contain links to third-party websites, maps, messaging applications, or other services.
We are not responsible for the privacy practices of third parties.
Review their privacy policies before providing information.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time.
If a change is material, we will provide notice through the app, email, website, or another reasonable method.
The “Last Updated” date will show when the policy was most recently revised.
